However, if the seller is exempt, the buyer has to cover it.<\/p>\n<p>Although sellers are responsible for covering New York real estate transfer tax and property transfer taxes in NYC, it is not uncommon for the seller to <strong>pass on this cost to the buyer<\/strong> as part of the sale price. The likelihood of the state transfer tax to be passed on to the buyer increases when the real estate market is tilted in favor of the seller.<\/p>\n<p>However, in such cases, the shifting of responsibility for the state transfer tax must be explicitly mentioned in the contract between seller and buyer. Per state regulations, the seller cannot pass these costs on directly or indirectly, unless the buyer is informed and in agreement. If the buyer does pay state transfer tax, <strong>the cost of the payment is deducted <\/strong>from the sale price (or total amount of value) that is taxed.<\/p>\n<p>In cases where the buyer has to cover the state realty transfer tax because the seller has failed to do so, the buyer has the <strong>right to legal action<\/strong> against the seller to recover the cost.<\/p>\n<h3  id=\"modification-repayment\">\n\t\t\tHow Is the Mansion Tax Calculated in New York State?\t<\/h3>\n\t<p>The New York mansion tax is calculated as an ad valorem or value-based tax for the transfer of residential properties of $1 million or more. The New York mansion tax represents<strong> an additional tax of 1%<\/strong> <strong>applied to the sale value<\/strong> of the home.<\/p>\n<p>The same additional 1% tax is also charged on the sale of co-ops shares of $1 million and over.<\/p>\n<h3  id=\"modification-repayment\">\n\t\t\tWho Pays the New York State Mansion Tax?\t<\/h3>\n\t<p>The New York State mansion tax is the <strong>responsibility of the<\/strong> <strong>buyer<\/strong>.
